Introduction and Acceptance of Terms

Welcome to Create a Caricature of Me (accessible at www.createacaricatureofme.com), an AI-powered caricature and cartoon portrait generation service. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Description of Service

Create a Caricature of Me provides an AI-powered platform that allows users to upload photos and generate caricature-style portraits using artificial intelligence technology. Our service includes:

AI caricature generation from uploaded photos
Multiple artistic styles and customization options
Credit-based usage system (one-time credit packs and subscription plans)
Image downloading and sharing capabilities

User Accounts and Registration

Account Creation: To access our caricature generation features, you need to create an account via Google OAuth or other supported login methods. You must provide accurate and complete information during registration.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Age Requirement: You must be at least 13 years of age to use this service. If you are under 18, you should use this service under the supervision of a parent or guardian.

Credits and Payment

Credit System: Our service operates on a credit-based system. Credit consumption per generation varies based on generation type, output quality, and size settings. The exact credit cost is shown in the product interface before you confirm generation.
Credit Packs: One-time credit pack credits do not expire and remain available in your account until used, unless removal is required by law, fraud prevention, or account abuse enforcement.
Subscriptions: Subscription plans provide monthly credit allocations. Unused subscription credits may roll over for one month, subject to a maximum cap. Subscription credits do not carry over beyond the rollover period.
Refund Policy:
- Unused one-time credit packs: Eligible for a full refund within 7 days of purchase only if no credits from that order have been used.
- Used credits: Once any credits from the order are used, the order is non-refundable except where required by applicable law.
- Technical issues and billing errors: Failed tasks caused by platform issues are compensated with credit returns. Duplicate or incorrect charges are eligible for payment refunds after verification.
- Subscriptions: First-time subscription purchases may be reviewed for refund requests within 7 days of the initial charge. If no subscription credits are used in that billing cycle, a full refund may be granted. If usage is below 30% of that cycle's credit allocation, we may offer credit compensation first and may offer a partial payment refund at our discretion. If usage reaches or exceeds 30%, the charge is generally non-refundable except where required by applicable law. Refund eligibility is determined by credits consumed, not by number of images generated. Renewal charges are generally non-refundable once processed, except where required by applicable law. You can cancel anytime to stop future renewals.

User Content and Intellectual Property

Your Photos: You retain all ownership rights to the photos you upload. By uploading them, you grant us a limited, non-exclusive license solely for the purpose of generating caricatures for you. To protect your privacy, uploaded photos are automatically deleted from our servers within 24 hours after generation.
Generated Caricatures: You own all rights to the caricature images generated from your photos. Due to our strict privacy protection policy, generated images are only accessible for 24 hours after generation, after which they are permanently deleted from our servers. We strongly recommend that you download and backup your favorite generations promptly.
Platform Assets: All platform code, model integration logic, product designs, and associated intellectual property remain the property of Create a Caricature of Me.

Prohibited Conduct

You agree not to:

Upload photos containing illegal, obscene, or harmful content
Upload photos of individuals without their consent
Use the service to create content that harasses, threatens, or defames others
Attempt to reverse-engineer or extract our AI models or algorithms
Use automated tools to mass-generate caricatures beyond normal usage patterns
Resell or redistribute generated images in bulk as a competing service
Interfere with or disrupt the security or performance of the service

Privacy and Data Collection

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We do not guarantee that:

AI-generated caricatures will meet your expectations in all cases
The service will be uninterrupted or error-free
Generated images will be perfectly accurate representations

We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Create a Caricature of Me shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service, including but not limited to loss of data, revenue, or profits.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users. Upon termination, your right to use the service will immediately cease, but treatment of any remaining credits will follow these Terms and applicable law.
